States with laws prohibiting ENDS sales to minors
- More than 16 million children younger than 18 years can legally purchase ENDS in the 11 states, including the District of Columbia, with no laws prohibiting ENDS sales to minors.
- ENDS sales to minors are prohibited in 40 states.
- ENDS sales are prohibited to persons younger than 18 in 36 states and younger than 19 in Alabama, Alaska, New Jersey, and Utah.
- Twelve states enacted laws during 2010-2012 prohibiting ENDS sales to minors; 12 states enacted such laws in 2013, and 16 states enacted such laws in 2014.
Smoke-free laws, ENDS use, and ENDS sales to minors
- Of the 40 states with laws prohibiting ENDS sales to minors, 21 do not have laws prohibiting smoking in private worksites, restaurants, and bars.
- Of the 27 states with comprehensive smoke-free laws, only three states (New Jersey, North Dakota, and Utah) also prohibit indoor ENDS use.
- The two states prohibiting ENDS sales to minors and indoor ENDS use are New Jersey and Utah.
- Nevada, Pennsylvania, and Texas are the three states with neither a law prohibiting ENDS sales to minors, nor a law prohibiting indoor ENDS use, nor a law prohibiting smoking in worksites, restaurants and bars.
