Notice of Proposed Rulemaking 42 CFR Part 34: Medical Examination of Aliens – Revisions to Medical Screening Process

On June 23, 2015, the Department of Health and Human Services (HHS)/Centers for Disease Control and Prevention (CDC) posted a Notice of Proposed Rulemaking (NPRM) to the Federal Register to revise the medical screening process for the medical examination for aliens (e.g., immigrants, refugees, asylees, and parolees).  This NPRM proposes an update to 42 CFR part 34 to use current medical standards and terms that are used by public health partners.

HHS/CDC has authority to establish requirements for the medical examination of aliens before they may be admitted into the United States. HHS/ CDC/Division of Global Migration and Quarantine administers these regulations. This revision will help to improve requirements set by HHS/CDC to protect U.S. public health.

The period for public comment on the NPRM will close on August 24, 2015. After reviewing and considering all comments received, CDC/HHS will publish a final rule to the Federal Register.
